Terms of Service

1. Acceptance of Terms

By accessing or using TRaX Streaming ("Service"), operated by TRaX ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you must not access or use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.

2. Description of Service

TRaX provides a professional multi-platform streaming platform that enables content creators to broadcast video streams to multiple destinations simultaneously. The Service includes:

  • A web-based streaming studio for managing and broadcasting live video
  • Multi-platform distribution to third-party services such as Twitch, YouTube, Facebook, Twitter/X, LinkedIn, Kick, TikTok, Instagram, and Rumble
  • Collaborative streaming features including shared input between users ("friend input sharing")
  • WebRTC-based stream preview and playback
  • Media file upload and storage
  • Stream analytics and performance metrics

3. Account Registration and Security

To use the Service, you must create an account by providing a valid email address, your name, and a password. You may also sign in using Google OAuth through our authentication provider. You agree to:

  • Provide accurate, current, and complete information during registration
  • Verify your email address via a one-time code sent to the email you provide
  • Maintain the security of your password and any two-factor authentication (TOTP or passkey) credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe have been compromised.

4. Subscriptions, Payments, and Billing

Certain features of the Service require a paid subscription. By subscribing, you agree to the following:

Plans and Pricing

We offer Starter, Pro, and Enterprise subscription tiers. Pricing and included features for each tier are displayed on the Service at the time of purchase. Add-on inputs and outputs may be available for additional cost.

Free Trial

New accounts may be eligible for a 14-day free trial. At the end of the trial period, your subscription will begin and you will be charged unless you cancel before the trial ends.

Billing

All payments are processed through Stripe. By providing payment information, you authorize us to charge the applicable subscription fees on a recurring basis (monthly or annually, depending on your selected billing cycle). You are responsible for keeping your payment method current.

Cancellation and Refunds

You may cancel your subscription at any time through the billing section of your account. Cancellation takes effect at the end of the current billing period. Refund eligibility is determined based on your usage of the Service during the billing period, including total streaming time.

5. User Content and Streaming

Ownership

You retain all ownership rights to the content you create, upload, or stream through the Service. By using the Service, you grant us a limited, non-exclusive license to process, transmit, and temporarily store your content solely for the purpose of delivering the Service (e.g., encoding, relaying streams to your configured destinations, and storing uploaded media files).

Acceptable Use

You agree not to use the Service to:

  • Stream, upload, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
  • Infringe on the intellectual property rights of others
  • Distribute malware, spam, or other harmful content
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use the Service to violate the terms of any third-party platform you stream to

DMCA and Copyright

We respect intellectual property rights. If you believe content on or distributed through our Service infringes your copyright, please contact us at [email protected] with a description of the copyrighted work, the location of the infringing material, and your contact information. We will respond to valid takedown requests in accordance with the Digital Millennium Copyright Act (DMCA).

6. Third-Party Platform Connections

The Service allows you to connect your accounts on third-party streaming platforms (such as Twitch, YouTube, Facebook, and others) to enable multi-platform distribution. By connecting a third-party account, you:

  • Authorize us to access your account on that platform using OAuth tokens you provide
  • Acknowledge that your use of those platforms is subject to their own terms of service
  • Accept that we are not responsible for any actions taken by third-party platforms, including suspension or termination of your account on those platforms
  • May disconnect your third-party accounts at any time through your account settings

We store platform connection data (such as your platform username, user ID, and OAuth tokens) to maintain your connections. Stream keys and RTMP URLs you provide are stored to enable stream distribution.

7. Collaborative Streaming Features

The Service includes collaborative features that allow users to share streaming inputs with other users ("friend input sharing"). By using these features:

  • You consent to sharing your selected inputs with the users you designate
  • You are responsible for obtaining appropriate permissions from any individuals appearing in your shared content
  • You acknowledge that shared inputs may be visible to and used by the recipient in their streams
  • Either party may revoke sharing at any time

Shared input approval may be required depending on your studio settings. Approval actions are logged for accountability.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions, including but not limited to interrupted or failed live streams.

9. Intellectual Property

The Service, including its software, design, logos, and documentation, is the property of TRaX and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our prior written consent.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including if we reasonably believe you have violated these Terms. Upon termination:

  • Your right to use the Service ceases immediately
  • Your active subscription will be cancelled
  • We may delete your account data after a reasonable retention period
  • Provisions of these Terms that by their nature should survive termination will survive (including limitation of liability, intellectual property, and governing law)

You may terminate your account at any time through your account settings or by contacting us.

11. Limitation of Liability

To the maximum extent permitted by applicable law, TRaX and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising from:

  • Your use of or inability to use the Service
  • Interruption, loss, or corruption of live streams or recorded content
  • Unauthorized access to or alteration of your data
  • Actions of third-party platforms connected through the Service
  • Any other matter relating to the Service

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Missouri, United States.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last updated" date above. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
